Commercial real estate debt and the next fiscal cliff? | REJournals.com

While a majority of America is keenly aware of the housing bubble, and at least somewhat familiar with the unraveling of the European markets, little energy is being focused on what may very well be the nation?s next looming fiscal crisis: the large volume of commercial real estate debt maturing during the next seven years.

According to Trepp, a provider of CMBS analytics and data to the securities and investment management industry, there will be more than $2 trillion of commercial real estate loans maturing by 2017. It?s estimated that half of them are ?underwater.? This means that fully $1 trillion in commercial real estate loans will mature without a clear refinancing strategy. These loans will not be refinanceable at existing debt levels, due to a decrease in underlying asset value. And today?s lending standards are much tighter than those of the middle 2000s, which further compounds the problem.

The lenders holding these overvalued loans will seek to either (1) right-size the loan balance at maturity through a large equity injection by the borrower (if an extension is even entertained), (2) foreclose on the loan and sell the underlying collateral or (3) sell the loans at the maximum price attainable (oftentimes at a discount to the par value). In each of these resolutions, there will be significant opportunity for borrowers and third-party buyers alike to purchase real estate or real estate debt at significant discounts to legacy value.

This massive de-leveraging of commercial real estate not only creates valuable buying and restructuring opportunities, it also highlights an even larger underlying problem: Who is going to be the capital provider for these fast-moving and non-traditional real estate transactions?

All-Too Common Scenarios

A commercial real estate developer that financed a retail project in 2005 today finds that the property is now worth less than the face value of the debt owed on the asset.

Tenants have left the property, rents have fallen from peak pricing and though new tenants are seeking to lease the space at lower rental rates, there is a need for capital to pay for tenant improvements and leasing commissions. To add to the complexity of the situation, perhaps the existing lender has recently called a maturity default and is not willing to offer any extension or forbearance options. Since this loan may be non-recourse, and currently not covering debt service payments, there is little incentive for the borrower to make interest payments out of pocket or inject a large amount of fresh capital into the project to ?right-size? the loan and find a new conventional lender.

In the above scenario, there are several different potential outcomes for the asset, and several pitfalls with conventional financing for each:

1. The original lender forecloses on the asset and sells to a new owner: A new operator sees this as a value investment, but few lenders are willing to lend on an asset that is being operated by a bank or receiver, and is under-performing, and will not cover debt service upon the inception of a new loan. Therefore, only cash buyers can purchase the now distressed asset.? Constraining the buying pool to this group reduces asset pricing, and therefore the bank?s ultimate recovery.

2. The bank offers the borrower a discounted payoff on an existing loan. In this situation, it is very difficult for a borrower to find a new lender to provide the capital to pay off the legacy lender, both because the payoff opportunity is likely only available for a short period of time and because there is institutional reluctance among banks and traditional lenders to replace what is viewed as a competitor?s problem.

3. The bank sells the loan at a discount. Lenders may take this approach to achieve a quicker resolution than they might get through foreclosure and sale, to potentially preserve a banking relationship with a customer, or simply to get the bad loan quickly off the balance sheet. It also allows the legacy lender the ability to avoid the moral hazard of providing the existing ?bad? borrower a discounted payoff opportunity.

Traditional real estate lenders?banks, conduits, and insurance companies?are simply not able to provide the responsiveness and creativity that these scenarios often demand. Typical 60- to 90-plus-day closing timelines, extensive third-party appraisals and multiple layers of management often negate any potential financing before a loan application is even submitted. Accelerated and reliable deal execution is almost completely non-existent in this new lending landscape, and yet it is the most important factor in managing the tremendous overhang of legacy debt.?

Where to Turn?

Commercial real estate bridge capital sources?nimble and capable debt and equity providers?are stepping up to fill the void that conventional lenders can?t and won?t. Niche capital sources will indeed welcome the opportunity to provide the borrower the necessary proceeds for a short period of time to re-stabilize the asset, and ultimately refinance it at an appropriate debt level.

Such a partner can:

1. Provide the debt necessary for the operator to quickly purchase and re-stabilize the property so that it will be more financeable in the traditional real estate debt markets.

2. Seek out these value opportunities and can provide the capital necessary to allow the borrower to take advantage of a discounted payoff opportunity. The borrower would use the lender?s proceeds for a short period of time to re-stabilize the asset, and ultimately refinance at an appropriate debt level with a traditional real estate lender.

3. Facilitate opportunities for a new value-seeking borrower to purchase a property that a traditional lending source may not want to lend on, particularly if it has been neglected by the prior owner.

4. Acquire notes to manage, service and work out, potentially in partnership with the original borrower.

To Make Matters Worse?

Compounding this problem can be issues of deal size and geography. Transitional situations are more typical for loan and property sizes under $10 million?too small for larger institutional investors to take interest in. Furthermore, coastal money tends to focus on the coastal markets, often ignoring underserved areas needing these types of solutions and relief, such as Nashville, Dallas, Phoenix, Detroit, Houston, Charlotte, Cleveland, Tampa and Atlanta.? Some examples of transitional financing successes:

  • One instance is a 312-unit apartment complex in Dallas, a property that was originally acquired in 2006 for $14 million and financed with $10 million in debt. The deterioration of real estate values in 2008 resulted in the property becoming overleveraged. This, along with the borrower?s expectation that it would lose the property, resulted in reduced investment and focus on the asset.

    Ultimately, in the interest of avoiding a lengthy and costly foreclosure, receivership and liquidation process, the lender offered the borrower a discounted payoff of the loan for $5 million, or 50% of the legacy debt amount. But the payoff would have to occur within three weeks.

    Fortunately, this borrower was able to secure a $5.2 million mortgage loan in this time-compressed situation. The recapitalized balance sheet and additional term allowed the borrowers to reinvest time and capital in the asset. The borrowers stabilized the property and ultimately refinanced the bridge loan within 13 months.

  • Another interesting success story is a 300-unit hotel located in Lexington, Ken. The property was one of the last non-franchised assets owned by a major flag operator and was being acquired by an experienced hotel operator planning to reposition the hotel under a new flag. Traditional financing for this transaction was unavailable because it involved a complicated ground lease, brand transition and a short time frame to close. Closer examination revealed a backlog of room bookings, projected event-based market factors, and low loan-to-replacement value.

    The operator was able to secure a 12-month, $4.9 million loan that gave the borrowers time to transition the brand, stabilize the asset, and refinance into long-term debt with an SBA loan.

  • In Memphis, the operator of a 150-unit apartment building had borrowed $4.4 million against the property in 1999 and eventually lost it to foreclosure in 2009.The prior lender took the property back as real estate-owned (REO) in September 2009 and sold it in May of 2010 to a new investor that needed financing. The new owner acquired the property for $2.9 million and invested $700,000 in acquisition equity in addition to escrowing $550,000 for capital improvements.

    Abridge loan of $2.2 million was used to finance the transaction. This loan represented a 50 percent discount to legacy debt, and less than $15,000 per unit. This creative loan gave the borrower time to make capital improvements to the asset and stabilize the occupancy; it was eventually refinanced by a $3.6 million Fannie Mae loan.

Getting Creative

For brokers, borrowers and lenders alike, the lessons are these:

1. Don?t assume. There is a danger in assuming the banks are freely lending again?and equal folly in assuming that there are no capital providers looking to invest in opportunistic situations. Do your homework and evaluate all options.

2. Understand your position and desired outcomes. If you are a property owner, do you want to retain the asset and create value, but feel like you?re in a no-win situation with your current debt situation? Determine what your true endgame is?it?s often not default?and find the solution that will achieve it.

3. Time is of the essence. Know your time horizons. If traditional lending sources are not going to be an option for you to restructure your debt, it?s better to know that as early as possible so that you can start making plans B and C.

4. Deal with trusted partners.The dynamic financing markets, coupled with the great need for capital, and the promises of new and lucrative opportunities have given rise to a lot of new names and players promising solutions that they cannot deliver. Do your homework, get references, and make sure you are dealing with capitalized partners that have a verifiable track record of honest and responsive business practice.

Ultimately, the chief lesson is this: We must recognize the reality and severity of the times that lie before us. The over-leveraging of over-valued properties pre-2008 will not be solved by organic value growth, increasing rental revenue, inflation or otherwise.? The near-term expiration of nearly $1 trillion in legacy debt will require a broad-based de-leveraging, and the entire universe of players in the commercial real estate market?from borrowers to lenders and brokers?need to work in concert to develop creative, flexible solutions for the spectrum of property owners throughout the country that will need them.

Notre Dame reigns atop college football again

LOS ANGELES (AP) ? The postgame roars from Notre Dame's locker room echoed right through the Coliseum's thick cement walls and metal beams Saturday night, moving around the 89-year-old arena like a long-absent force of nature.

After decades away, the Fighting Irish are back on top of college football ? unmatched in the rankings, unblemished in the standings, and unequivocally ready for a chance to end a 24-year national championship drought.

Manti Te'o, the star Irish linebacker from Hawaii who led this improbable revival season, took a moment to listen to those echoes.

"This is where you want to be when you go to Notre Dame," he said.

The Irish are No. 1 again ? a Golden Dome atop their sport.

Notre Dame (12-0) beat Southern California 22-13 to complete its first unbeaten regular season since 1988. That's also the last championship year for the school that produced a legion of the sport's most memorable figures: Knute Rockne, the Four Horsemen, Paul Hornung, Joe Montana ? heck, even Rudy Ruettiger.

A no-nonsense win over Notre Dame's intersectional rivals in Los Angeles capped a year of historic dominance for a defense led by Te'o, its inspirational Heisman contender. That defense allowed just nine touchdowns all season long, capped by four downs of unyielding play while backed up to its goal line by the Trojans in the final minutes.

"You just put the ball down in front of us, and if there's time on the clock, we're never going to give up," defensive end Kapron Lewis-Moore said.

These Irish never flinched, either in dire late-game circumstances or under the weight of history that has crushed decades of previous Notre Dame teams. After beginning the year unranked and projected for maybe eight victories by optimistic pundits, the Irish produced a marvelous season of old-fashioned, hard-nosed football amid the wacky spread offenses and garish neon uniforms that seem to dominate the sport these days.

After winning half of their games by nine points or fewer, including two hair-raising escapes in overtime victories, it's clear these Irish have something else going for them as well.

"Not saying it was lucky, but luck doesn't hurt," said Terry Brennan, who played at Notre Dame in the late 1940s and coached the team from 1954-58. "The point is, they got the break and they took advantage of it. That's the key."

The Irish have six weeks to prepare for the BCS title game on Jan. 7, but coach Brian Kelly's restoration of the Notre Dame mystique could linger much longer.

The Golden Dome atop Notre Dame's administration building has regained its luster at a school where coaches Bob Davie, Tyrone Willingham and Charlie Weis all failed to restore the program to its most recent glory under Lou Holtz in the late 1980s. All told, Notre Dame lost at least three games every season between 1993 and this fall ? not bad, but not good enough to contend for national titles.

Just three years after taking over a 6-6 team with ancient expectations annually dwarfed by the modern realities of competing at a Catholic school in frigid northern Indiana with tough academic standards, Kelly has put the Irish back on top.

And though he's still one win shy of ultimate success, Kelly did it in his third year ? the same season in which Frank Leahy, Ara Parseghian, Dan Devine and Holtz all won national titles during their tenures at Notre Dame.

"It's easy to say, 'Well, yeah, I'm surprised,'" Kelly said. "But when you go in that locker room and are around the guys I'm around, you're not surprised. The commitment they've made ? they've done everything I've asked them to do. It doesn't surprise me anymore."

Thousands of Irish fans turned up at the Coliseum for the regular-season finale, demonstrating the wide reach of Notre Dame's appeal. The Irish have embraced their status as an international program in recent years, playing everywhere from Yankee Stadium to Dublin, Ireland, while Kelly put the ingredients in place for this season's success.

Athletic director Jack Swarbrick, who replaced Weis with Kelly three years ago next month, acknowledges he expected the Irish to need maybe one more year to contend at an elite level.

Although Notre Dame's defense was clearly tough, nobody could have expected such success from an offense now led by the likes of quarterback Everett Golson, who redshirted last year, and tailback Theo Riddick, who was a slot receiver last season.

The Irish were nobody's favorite, but they've ended up on top. The 84-year-old Brennan, who was just 25 when he took over the Irish program in 1954, knows all about the importance of seizing the moment.

"Grab it when you can," he said. "Next year you might have injuries, and the ball bounces the other way."

The Irish returned home Sunday knowing they've still got a bit of work to do ? and if their season to date is any indication, they're still hungry.

Notre Dame is likely to be an underdog to an opponent from the Southeastern Conference in the BCS title game. The Irish will rely on the experience of their unbeaten season, the history of past champions wearing their uniforms, and the support of untold millions who love what the team once represented ? and what it means again.

Te'o, who turns 22 in January, hadn't been born the last time Notre Dame won a national title. He still knows the date of the last Irish national championship by heart, thanks to the sign at the end of the tunnel at Notre Dame Stadium where he steps on that hallowed field each game day.

"I'm just hoping that we can add our year to it," Te'o said. "But it's going to take a lot of work."

ScienceDaily (Nov. 21, 2012) ? Infants seem to develop at an astoundingly rapid pace, learning new things and acquiring new skills every day. And research suggests that the abilities that infants demonstrate early on can shape the development of skills later in life, in childhood and beyond.

How Do You Learn to Walk? Thousands of Steps and Dozens of Falls per Day

How do babies learn to walk? In this study, Adolph and colleagues recorded 15- to 60-minute videos of spontaneous activity from infants. They then coded the videos for the time infants spent walking and crawling, the number of crawling and walking steps infants took, and the number of falls infants experienced whether walking or crawling. The researchers found that the infants moved a tremendous amount and that new walkers moved faster than crawlers but had a similar number of falls at first and fewer as they became more experienced. This suggests that infants are motivated to begin walking because they move faster without falling more and that they dramatically improve their walking skills through immense amounts of practice.

Implications of Infant Cognition for Executive Functions at Age 11

Do basic information processing skills in infancy have any bearing on later executive functioning skills in children? Infants were assessed for memory, processing speed, and attention at age 7-12 months and age 24-36 months. When they were 11 years old, the children returned to the lab and were assessed for various different kinds of executive functioning skills, including working memory, inhibition, and shifting. Rose and colleagues created a statistical model that used infant abilities to predict executive functioning later in childhood and they found that this model fit the data well. The model indicated that processing speed in infancy significantly predicted working memory and shifting ability at age 11 and that memory in infancy significantly predicted shifting at age 11. This research supports the idea that infant cognitive abilities provide a foundation for the later development of executive functioning abilities.

One-Year-Old Infants Follow Others' Voice Direction

Can infants determine what adults are paying attention to by listening to their voices? Rossano and colleagues conducted an experiment in which infants were placed in front of a wooden barrier that had a box sticking out of either side. A member of the research team hid behind the barrier and spoke in the direction of one of the boxes. The researchers then watched to see which box the infants moved toward. Rossano and colleagues found that infants moved toward the box that was in the direction of the researcher's vocalization. A follow-up study that examined the same task with chimpanzees found that they showed no ability to follow voice direction. This suggests that infants -- but perhaps not chimpanzees -- can infer what an adult is paying attention to based on voice alone.

Anybody else obsessed with communications and with psycholog ...

Hey, everyone. I noticed from the time I was very small that I was absolutely obsessed with the "why" behind what people do (practically everything that they/we do) and with figuring out why people communicate the way they do.

I have always had this need to learn more and more about these two things so that I can communicate like a semi-normal person in public. Laughing (Or I hope that's what I'm doing. Not always sure!)

I can never get enough of marveling over why people do what they do socially and why they say what they say. Body language, different greetings, different tones of voice, what annoys people and when and why all totally "grab" me. I want to know why. All the time. Why did this make the person laugh but that not make the person laugh? Why was this funny one time but not three? Why was it funny three times but not ten? And on and on.

I will never have it all figured out but it did open up an interest in psychology for me, and I don't think that's a bad thing, so I consider it an okay obsession.

MANHATTAN, Kan. - Rodney McGruder had 16 points and three rebounds to lead Kansas State to a 74-55 win over North Florida on Sunday afternoon.

Playing a team they nearly lost to a year ago, the Wildcats looked like a better team this time around. Despite needing overtime to beat the Ospreys last season, this time around, the contest was never in serious doubt.

Kansas State (4-0) opened the game on a 12-4 run with six points each from McGruder and Nino Williams, and led 16-6 with 13:23 to play in the first half. A 7-2 run helped the Wildcats go-ahead 23-9 and never looked back.

Beau Beech led North Florida (1-3) with 15 points and seven rebounds.

The Government has signaled that the new tax will be collected from mid-2013 but don?t let that fool you into thinking you?ll get a 50% discount in 2013, you?ll have the pay the full annual sum by the end of 2013!

Of course, it could also be zero if the Government follows the suggestion by Fianna Fail to substitute other measures for the property tax, but given the minimum ?3.5bn size of the adjustment in 2013, the specific inclusion of a property tax in the Memorandum of Understanding with the Troika and the political capital already expended on the household charge, it is a safe bet that there will be a property tax in 2013 and that it will be an average of around ?400.

It is understood the so-called ?Expert Report? which was produced by a group led by quango-king Don Thornhill was delivered to Minister for the Environment Community and Local Government, Phil Hogan in July 2012 before the Dail summer recess, but it has remained under tight wraps since. It is unlikely to contain any surprises, this is generally going to cost you a few hundred euro a year and it will be a new tax, notwithstanding the fiasco of the 2012 household charge, which according to the Local Government ?Management Agency has not been paid by more than 600,000 households at the end of October 2012. Preparations are already advanced to have the once-feared Revenue Commissioners ? those nice people who agreed a ?2.1m tax settlement with Deputy Mick Wallace that might be paid off, at Mick?s discretion it should be said, over the next 50 years ? collect the tax and it may form part of your tax code if you?re on PAYE; the Government has been seriously rattled by the resistance to the ?100 household charge in 2012 and at this late stage of the year, there still appears to be widespread non-compliance.

There are various groups of opponents to the new property tax ranging from those objecting to any form of property tax at all, to those advocating different means of levying the tax and the account that should be taken of factors such as location and size of the property and site to the income of the householder.? Given the bluntness that has characterized this Government?s term in office, you can probably expect a bald 0.25% charge in 2013 based on a band of values assessed by your local authority working off your registration information provided when you paid the 2012 household charge.

In terms of alternatives, we have Property Industry Ireland who submitted its lightweight pre-budget document on 1st October 2012 which simply called for general clarity and also a reform to property taxation, particularly with commercial rates. Last week, upmarket estate agents Lisney produced its own pre-budget submission and called for a flat rate based on bands of values but then adjusted for size. Lisney also wants to see residential stamp duty reduced or abolished. ?The Society of Chartered Suveyors in Ireland has produced its pre-budget submission and a separate submission on property tax where the Society appears to advocate a flat tax in the short-term though it is unclear precisely what its preferred option is for a permanent property tax. ?An updated submission from the Society was made in September 2012, but it again refrains from recommending a prescriptive method, save to say values should be self-assessed. The Dublin Chamber of Commerce is advocating a rate set by the 34 local authorities which will obviously benefit Dublin households where the concentration of population will lead to lower average household bills.? For all the submissions, it is likely to be a simple national tax at 0.25% of the upper band value as calculated for your home by your local authority and payable from July 2013.

NCS Division I football roundup: James Logan runs over Freedom in NCS football playoffs

The James Logan High football team advanced to the North Coast Section Division I semifinals for the first time since 2007, beating visiting Freedom 33-18 on Saturday evening.

James Logan took a 20-2 lead in the first half and never looked back, as Freedom's explosive offense couldn't hang onto the ball.

Warren Miles Long had 113 rushing yards at the half, including touchdown runs of 18 and 2 yards. He finished with three touchdowns and 290 yards on the ground.

Quarterback Dante Mayes threw an interception on Freedom's first play from scrimmage. That gave the Colts the ball on the Freedom 31-yard line, and Long scored six plays later.

Freedom also fumbled twice in the half and finished with five turnovers.

A bad snap on a Freedom punt led to a short field for the Colts. They took advantage when Jeffrey Prothro scored on 2-yard quarterback sneak to make the score 20-0 with 7 minutes left in the half.

Sixth-seeded Freedom (9-3) finally got on the board with a safety late in the first half. The Falcons then marched down to the Logan 8, but without any timeouts remaining, ran out of time.

The No. 3 Colts (11-1) held Freedom's offense to 41 rushing yards and 95 passing yards in the first half.

In the semifinals, James Logan will play at No. 2 California next Saturday at 7 p.m.

Both teams were on a serious roll entering this highly anticipated quarterfinal.

Freedom had won eight straight and the Bay

Valley Athletic League title, and Logan has cruised to five consecutive wins since its 20-13 overtime loss to Del Oro-Loomis.

The trio of Mayes, running back Joe Mixon and receiver Darrell Daniels made the Falcons one of the top offenses in the area, but Logan counters with a defense that gives up an average of just eight points a game. Long has spearhead that defensive effort.

Amador Valley 28, San Ramon Valley 25: The fifth-seeded Dons advanced in a game that had a wild third quarter that saw the lead change hands three times in less than four minutes.

Alejandro Apodaca scored on a 15-yard run to give Amador Valley a 20-13 lead with 5:27 left in the third quarter. But No. 4 San Ramon Valley answered when Peter Tagliaferri returned an interception 41 yards for a touchdown to cut the Dons' lead to 20-19, then Wolves quarterback Cameron Birse found Justin Bangay open on a 56-yard TD pass with 3:01 left in the third to give San Ramon Valley a 25-20 lead.

Amador Valley went ahead 28-25 just 46 seconds later, as Apodaca scored on a 78-yard run.

The game was tied 13-13 at halftime, and Birse had a hand in both of the Wolves' two touchdowns in the first half. He threw a 20-yard TD pass to Ryan Dunn, then completed a 5-yard scoring pass to J.J. Koski with 46 seconds left in the half that tied the score at 13.

Amador Valley plays at top-seeded De La Salle on Friday at 7 p.m.

The Tyee ? How a Dyslexic Student Could Change Canada's Schools

Moore vs. BC will have big effects, but only if we understand the binds North Van trustees faced.

When the Supreme Court of Canada handed down its decision last week in Moore v. British Columbia, I had mixed feelings.

The Court resolved a 15-year dispute between North Vancouver School District and the family of Jeffrey Moore, who in the early 1990s had been diagnosed as dyslexic and in need of special education in the district's Diagnostic Centre. When the district then cut the centre to save money, the Moore family had to put Jeffrey in a private school at the family's expense. Jeffrey did well there, and is now a young man reported to be working as a plumber.

I rejoice for the Moore family, and I admire their determination in fighting their case all the way to the Supreme Court.

But as a former North Vancouver school trustee, I sympathize with the trustees who made the cut, and with their successors who now must pay the Moore family for the costs they incurred to get their son the help he needed.

I served on the North Vancouver board from 1980-82, just as the role of school boards began a momentous change. Until then, boards could tax both homeowners and businesses within their districts. If they raised taxes too much, voters could oust them at the next election. And if the programs funded by those taxes didn't serve the kids well, the voters could oust them for that also. Trustees therefore had real power, and real responsibility.

That changed when the Bill Bennett Socreds diverted our business and industrial tax revenue into the provincial share of the school budget. This measure gave poor districts a fairer share of funding. But it sharply limited school boards' ability to provide programs tailored to their communities' needs. Now we could raise taxes on homeowners only, if we dared.

Inflation and recession

Compounding the problem was the impact of rampant inflation. North Vancouver came to an agreement with its teachers in that era that put us right on the provincial average: a 15 per cent increase in salaries and benefits. But those were also the days of 20 per cent interest on mortgages, and that eventually ended the inflation -- by inflicting a serious recession on all of North America.

Running for re-election in the fall of 1982, I could see how the recession was scaring people. With the B.C. economy sinking and businesses laying off people or just shutting down, voters wanted to minimize taxes like any other expense. Criticizing the schools for supposedly poor performance made it easier to justify cutting education funding, and the B.C. right-wing did just that. All-candidates' meetings got scary, and as a supporter of school spending I was briskly turfed out. Less than a year later, the restraint era began (now we'd call it austerity); B.C. teetered on the edge of a general strike.

A year after that, the Socreds fired the Vancouver School Board for failing to submit an acceptable budget, and we were well into the Thirty Years' War between teachers and provincial governments.

Doing Victoria's dirty work

In the course of that war, boards have lost all taxation and bargaining powers. The ministry of education tells them what their budget will be, and they must make do with it. If it's not enough for everything they think their schools can or must do, then they have to decide which programs to cut and schools to close. In effect, they do Victoria's dirty work.

Something else was going on in those years. Up until the late 1960s or early 1970s, Canadians and Americans alike had regarded education as a kind of reality show in which not everyone would stay on the island. Schools were selecting for particular academic skills, and flunking those who lacked them -- or shunting them into "vocational" programs.

Everyone accepted that in education, as in professional athletics or in paratroop training, not all would make the cut, nor should they. Few noticed, and fewer cared, that those cut tended to be minorities, working class, and those with physical and learning disabilities.

Gradually that attitude changed. Here in B.C. we saw it as early as the 1940s, when communities began to agitate for easier access to post-secondary education. As one of the early teachers in our provincial community college system in the 1960s, I saw the demand and was happy to try to meet it.

Moreover, the higher the education level achieved, the better a student's chances of employment, even in fields with no real need for traditional academic credentials. So by the time of the latest version of the B.C. School Act in 1996, the Preamble explicitly stated:

"The purpose of the British Columbia school system is to enable all learners to become literate, to develop their individual potential and to acquire the knowledge, skills and attitudes needed to contribute to a healthy, democratic and pluralistic society and a prosperous and sustainable economy."

The Supreme Court has rightly taken "all learners" to include Jeffrey Moore and students like him.

Punishing school districts

It was also in 1996 that Art Charbonneau, then the NDP minister of education, fired the North Vancouver School Board for failing to deal with a budget deficit. This carried on a tradition begun in 1986, when the Socreds had sacked the Vancouver board. Like the Socreds before them and the Liberals after, the NDP was underfunding the public system and punishing the districts that tried to maintain their programs.

Before that happened, the North Vancouver board already had years of experience in cuts and closings, including the 1994 shutdown of the Diagnostic Centre that Jeffrey Moore had needed. I can imagine the grim mood around the board table on the night that vote was taken.

The Supreme Court, second-guessing the board years later, said it should have considered cutting "discretionary" programs like North Vancouver's Outdoor School instead. But the Outdoor School has hung by a thread for most of the last 30 years, despite its demonstrated educational value to thousands of kids. Cutting it would have deprived all the district's children of a major learning experience.

This is not to say that Jeffrey Moore and kids like him should have been sacrificed for the greater good of their classmates. But neither should those classmates have been sacrificed.

A momentous change for Canadian schools

If I read the Court's decision (and the School Act) correctly, this and future provincial governments are now bound to provide funding that will ensure that all B.C. students, regardless of talents or disabilities, receive the kind of education set out in the School Act.

That would be a momentous change for schools across Canada as well -- perhaps comparable to Brown vs Board of Education, the 1954 U.S. Supreme Court decision that struck down racial segregation in the schools.

Many of our school-funding problems boil down to demographics: we built a system to serve the baby boomers that was too big for the baby bust of the 1970s and 1980s. Then the echo boomers arrived and put new stress on the system, followed more recently by immigrant kids. And precisely because we must increasingly depend on fewer working-age Canadians to support us all, every student should have the value of scarcity.

We have no disposable students; we need to give every possible kid both useful skills and a productive way to apply them in our economy. Jeffrey Moore is doing that, thanks to the investment his family made in him -- an investment the North Vancouver board should have been able to make 18 years ago. Instead the government of the day, like most B.C. governments, played for short-term political gain: Look how responsibly we control school boards' crazy spending!

Well, the long term has arrived. Governments and voters alike have to see that it's in their own interest to maintain the best possible education system for everyone. We failed to do that in the 1980s and thereafter, and now we are paying the price for it -- not just the North Van board, which must repay the Moores, but all of us.  [Tyee]

'Love Boat' producer Henry Colman dies at 89

LOS ANGELES (AP) ? Television producer and executive Henry Colman ? whose credits include "The Love Boat," ''Hawaii Five-O" and "Green Acres" ? has died at age 89.

An announcement Sunday by the Archive of American Television says Colman died Wednesday.

Colman's career dates to early commercial television, where he started as production coordinator on the musical show "Easy Does It." In 1951, Colman became assistant to the director for "Kraft Television Theatre" and later worked on such series as "Robert Montgomery Presents" and "Colgate Comedy Hour."

As a TV executive, Colman oversaw the pilot of "The Many Loves of Dobie Gillis" and worked on "Green Acres" and "Hawaii Five-O."

In the 1970s, he helped develop "The Love Boat," where he worked as line producer. Colman also produced the 1980s series "Hotel."

Was Petraeus affair linked to lax Libya response?

CIA Director David Petraeus abruptly resigned Friday, citing an extramarital affair and the need to sort out the ?personal and professional issues? involved.

The former commander of forces in Iraq and Afghanistan had built a stellar and nearly unassailable reputation ? but mounting criticism of the Central Intelligence Agency?s response to the Benghazi, Libya, terrorist attack in September was beginning to tarnish that reputation.

Word of Mr. Petraeus?s resignation sent ripples of stunned surprise through both the intelligence and military communities, raising questions that revolved around how long the affair had been going on and how an officer known for his rigorous self-discipline ? and attention to his reputation within the media ? could have made such a lapse in judgment.

In a letter of resignation accepted by the White House, Petraeus said he had been married 37 years but had exercised ?very poor judgment? in choosing to enter into an extramarital affair.

Petraeus, who was widely celebrated as a military commander and even occasionally mentioned as a potential presidential candidate, was sworn in as head of the CIA in September 2011 ? and had kept a low profile since. Now speculation is sure to proliferate over whether that low profile resulted from Petraeus focusing on America?s intelligence gathering or on personal matters.

In particular, members of Congress and other officials demanding answers about the Benghazi attack on the US consulate that resulted in the deaths of four Americans ? including the US ambassador to Libya, Christopher Stephens, and two CIA agents ? will want to know if there was any link between Petraeus?s extramarital activities and what has been increasingly criticized as the CIA?s weak performance on the night of the Benghazi attack.

More broadly, the reason for Petraeus?s departure will raise questions about any compromising of US covert operations and intelligence. The potential for blackmail of intelligence officers is always a concern about the spy corps, but the involvement of the nation?s top spy in an extramarital affair takes the concern to a new level.

The Federal Bureau of Investigation has been probing Petraeus and the potential security risks posed by his affair, CNN reported late Friday afternoon.

In the weeks since the Benghazi attack, officials have leaked information, including how Petraeus kept information on the CIA?s role in Benghazi so private that even Secretary of State Hillary Rodham Clinton was left to call Petraeus as the attack unfolded to try to get intelligence information from him.

Last week, CIA officials revealed that in fact, the intelligence agency?s operations in Benghazi dwarfed diplomatic operations at the consulate and that the CIA maintained what was described as an ?annex,? about a mile from the diplomatic mission.

State Department officials have said there was an informal understanding that the annex and its agents would come to the assistance of the consulate (which had private contractors providing security) if a need arose. CIA officials insist their agents responded to the consulate?s distress calls within a half-hour.

In a statement released Friday afternoon, President Obama praised Petraeus for his ?extraordinary service? to the country, adding, ?By any measure, through his lifetime of service, David Petraeus has made our country safer and stronger.?

In a statement, Sen. John McCain (R) of Arizona highlighted Petraeus?s role in Iraq, saying that his ?inspirational leadership and his genius were directly responsible ? after years of failure ? for the success of the surge in Iraq.?

But Petraeus?s success in Iraq and Afghanistan was a result to a certain extent of his focus on a counterinsurgency strategy that involved large numbers of troops fighting the enemy by incorporating nation-building into the battle. When Mr. Obama named Petraeus to head the CIA, it was widely interpreted as the president?s signal that he intended to wind down America?s wars and shift from a counterinsurgency strategy to counterterrorism.

Obama did not cite Petraeus?s reason for resigning but did say, ?Going forward, my thoughts and prayers are with Dave and Holly Petraeus, who has done so much to help military families through her own work. I wish them the very best at this difficult time.?

Mrs. Petraeus is the assistant director of the Consumer Financial Protection Bureau, where she supports veterans and troops facing difficulties as a result of the financial crisis.

Obama initially tried to convince Petraeus not to resign, according to some souces. ?I am told that President Obama tried to talk Petraeus out of resigning, but Petraeus took the samurai route and insisted that he had done a dishonorable thing and now had to try to balance it by doing the honorable thing and stepping down as CIA director,? Tom Ricks reports in his blog ?The Best Defense.?

Such a move is in keeping with the military culture in which Petraeus rose to the rank of four-star general.

Under the Uniform Code of Military Justice, adultery is a punishable offense for soldiers if the conduct is shown to be detrimental ?to good order and discipline in the armed forces or was of a nature to bring discredit upon the armed forces.?

Obama said that Michael Morell, deputy director of the CIA, would take over as acting director. Mr. Morell served briefly as acting director after Leon Panetta left the agency last year to become Defense secretary.

Petraeus was set to testify Thursday at a closed-door session of the Senate Intelligence Committee on the Benghazi attack, but it was unclear if his resignation would alter that schedule.

Sen. Dianne Feinstein (D) of California, the Intelligence Committee chair, told NBC News that Petraeus?s personal mistake should not have led to his resignation.

?I would have stood up for him,? she said. ?I wanted him to continue. He was good, he loved the work, and he had a command of intelligence issues second to none.?

Obama, after winning reelection Tuesday, was already expected to make some changes in his national security team for a second term, but early speculation had been that Petraeus would stay on at the CIA. Now the job of spy chief will be added to the new-team mix.

CHICAGO, Thursday, November, 8, 2012. What's the third Thursday in November? If you said Thanksgiving, you'd be wrong.? The third Thursday in November is Beaujolais Nouveau Day--celebrated around the world with France, the U.S. and Japan partying the hardest.

French law has decreed that the Beaujolais Nouveau wine, produced from the Gamay grape that grows in the countryside of the Beaujolais region of France, cannot be released until a second after midnight on the third Thursday of November. Then the race is on to be the first to serve and consume the new batch of the Nouveau.

Anything goes to distribute over 65 million bottles (approximately half of the region's total annual production) as fast as possible around the world.? In this past this has been done by motorcycle, balloon, truck, helicopter, Concorde jet, elephant runners, rickshaws and more.

Beaujolais Nouveau, is an affordable easy to drink fruity red wine that pairs well with many foods from pizza to Thanksgiving fare. There is only a small amount of tannins, thus the taste of the wine is dominated by fruity flavors such as banana, fig and pear.? The purple-pink hued wine is bottled only six to eight weeks after its harvest, making it an object of ridicule by some wine snobs but loved by the masses.

Beaujolais Nouveau Wine Fest.

Head to downtown LaGrange ?on Thursday, November 15? for their 10th annual salute to Beaujolais Nouveau. Guests can sample 18-20 different wines as well as appetizers. 5p.m. to 8p.m. Tickets are $50 per individual or $80 for two.

On Election Night, score a victory for traditional media

While people used social media to share Election Night comments, a surge in news site traffic and robust TV viewership showed so-called legacy media are still the preeminent sources for news.

Social media may be the darling of a mobile generation weaned on interactivity and speed, but Election Night this year delivered a small silver lining of good news to so-called legacy media outlets such as newspapers and television.

With massive increases in traffic?on news sites linked to such outlets as The New York Times and ABC News and with 66 million viewers watching TV, news of the legacy media?s death ? to?paraphrase Mark Twain ? is greatly exaggerated.

?Content is still king,? says Len Shyles, communication professor at Villanova University in Philadelphia.

While many people now interact with social media such as Twitter and Facebook while they are watching TV, Professor Shyles says, ?they are commenting on it, messing around with it, having fun with what they just heard, and sharing it with others.?

But, he points out, the legacy media is still the pre-eminent source, ?and social media is still ancillary.?

Legacy media are stage setters for social media actors, agrees Charles Dunn, author of ?The Seven Laws of Presidential leadership.?

Social media have come into their own as major players in political debate, he says via e-mail,??but legacy media continue to play the primary role in setting the stage for debate and discussion about political issues and personalities.?

Certainly the allocation of resources in the two campaigns leading up to Tuesday night supports this view.

According to the most recent report from the Wesleyan Media Project, the number of TV ads aired in the presidential general election passed the one million mark as of Oct. 29. The two candidates, their party committees, and supporting interest groups sponsored 1,015,615 ads since June 1, a 39.1 percent increase over 2008 and a 41 percent increase over 2004.

A recent student-conducted study from the Farmer School of Business at Miami University in Ohio also supports this media consumption model. When asked what media had the most influence on their knowledge of the issues in this election, 29 percent of student respondents said Fox News, 22 percent said social media such as Facebook and Twitter, and 12 percent said MSNBC.

Nearly 67 million viewers watch election coverage

LOS ANGELES (AP) ? President Barack Obama's re-election was well watched but wasn't the TV ratings record-breaker his first victory four years proved to be.

An estimated 66.8 million viewers watched election returns on broadcast and cable networks Tuesday, the Nielsen Co. said Wednesday.

The audience fell short of the record 71.5 million viewers who tuned in to the outcome of the 2008 contest and the historic election of the first African-American president.

NBC came out on top among all networks, averaging 12.1 million viewers during the three hours of prime time, 8-11 p.m. Fox News Channel held the No. 2 slot with 11.45 million viewers, the biggest average ever in the network's 16-year history.

Among other networks, ABC drew 10.52 million viewers, CNN had 9.25 million, CBS had 7.92 million, FOX (broadcast sister to Fox News) had 4.93 million and MSNBC had 4.7 million.

Cable rivals CNN and Fox News both could claim bragging rights, depending on how the pie is sliced.

Networks didn't call the race for Obama until after 11 p.m., so limiting ratings to prime time is akin to measuring viewership for the first three-quarters of an exciting football game decided in the fourth quarter.

Expand the window out to between 7 p.m. and 12 a.m., and Fox News had 10.6 million viewers to CNN's 8.9 million, Nielsen said.

Open it even wider, from 7 p.m. to 2 a.m., and CNN has a narrow edge over Fox News: 8.8 million to 8.7 million. The later hours include Romney's concession speech and Obama's victory speech ? events that, presumably, wouldn't appeal as much to the Republicans who make up the bulk of Fox News' audience.

Nielsen measured viewership on 13 networks, including ABC, CBS, FOX, NBC, PBS, Univision, Telemundo, CNBC, CNN, Fox News Channel, MSNBC, Current TV and TV One.

A Plea For An End To Internet Partisanship - Marketing Land

Google cofounder Sergey Brin?suggested?today that politicians elected tonight in the US elections should resign from their parties and act as independents. As a citizen of the internet, I couldn?t help but think I?d like to see the same thing happen among our internet rulers, the major internet companies.

So, to rewrite Brin?s request from that perspective:

It is ironic that whenever I have met with people from our major tech companies, they are invariably thoughtful, well-meaning people. And yet collectively, 90% of their effort seems to be focused on how to stick it to the other tech companies.

So my plea: please run your companies for the collective benefit of users and the internet, in the way you all so often suggest you want to. It is probably the biggest contribution you could make.

Quite seriously, I?ve met completely rational, thoughtful, well-meaning people at Google who nonetheless don?t prevent the company from sometimes acting in fiercely?competitive?ways toward other companies.

The same is true for other large internet companies, as well. Apple won?t work with Google; Twitter won?t work with Tumblr; Google won?t work with Microsoft; Facebook won?t work with Google.

I no more expect that partisanship will be abandoned in the tech world than I do in the political world. But if it does, perhaps a leader like Brin in the tech world might actually convince some on the political world to change.

Here?s a start. How about an official Google Voice app for Windows Phone? Microsoft is open to that bipartisanship, but to date, Google can?t muster the resources to make that happen, it seems.
